Terms and Conditions for Advertisement Purchase in the Waikato Official Regional Visitor Guide
- Introduction
These terms and conditions (the "Agreement") govern the purchase of an advertisement (the "Ad") by the Advertiser in the Mighty Waikato Visitor Guide - the 2025 Waikato Official Regional Visitor Guide (the "Guide") published by Hamilton & Waikato Tourism (the "Publisher"). - Eligibility
To be eligible for membership, a business must:- operate within the visitor sector; and
- be located within the boundaries of Hamilton & Waikato Tourism.
- Ad Specifications
- All advertisements will be in the same ‘list’ format.
- The Advertiser is solely responsible for provision of the content of the Ad. The Ad must comply with all applicable laws, regulations, and industry standards. The Publisher reserves the right to reject any Ad that it deems inappropriate, offensive, or misleading. Hamilton & Waikato Tourism is not responsible for the accuracy of any information provided by the Advertisers for their Ad.
- The Advertiser must provide all necessary Ad materials (eg images and text) utilizing the Booking Form by the agreed-upon deadline.
- Ad Rates
- All advertising rates quoted are in NZ dollars and exclusive of GST
- Payment Terms
- The Advertiser agrees to pay the Publisher the agreed-upon fee for the Ad.
- Payment is due in full upon placement of the order.
- An invoice will be provided, with payment due 20th of the following month.
- If payment is not received by the due date, the Publisher reserves the right to cancel the Ad or charge interest on the overdue amount.
- Advertising Order and Cancellation
- It is the Advertiser’s responsibility to ensure they have provided correct information and checked this before submitting their Booking Form. Once the Booking Form is submitted, changes are at the Publishers discretion and ad may incur additional charges to the advertiser.
- If the Advertiser intends to cancel the Ad, notice must be provided via email by 30 September 2024. Any advertising orders cancelled post-booking deadline will incur the full ad rate.
- Placement and Distribution
- The Publisher will make reasonable efforts to place the Ad in the designated section of the Guide. However, the Publisher reserves the right to adjust the Ad placement if necessary.
- The Publisher will distribute the Guide throughout the mighty Waikato. A digital version of the 2025 Waikato Official Regional Visitor Guide will be made available on waikatonz.com.
- Liability
- The Publisher shall not be liable for any loss, damage, or injury arising from errors or omissions in the Ad, or from any other cause related to the Ad.
- The Advertiser is solely responsible for the accuracy and legality of the Ad content. The Advertiser indemnifies and holds the Publisher harmless from any claims, damages, or liabilities arising from the Ad.
- Confirming space in the 2025 Official Regional Visitor Guide is also confirmation that you are compliant with the NZ Health and Safety at Work Act.
- If you are an adventure activity operator, confirming ad space is also confirmation that you have been compliant with WorkSafe New Zealand’s Adventure Safety audit process
- Project Cancellation due to minimum sales
- The Publisher reserves the right to cancel the project if a minimum level of advertising sales is not achieved by 30 September 2024. In the event of cancellation, all payments made by Advertisers will be refunded in full.
